Terms of Service

1. Who we are

BoomSauce is an email infrastructure product operated by Nimbus.io, LLC (“Nimbus,” “we,” “us”), a Florida limited liability company. The service is available at app.boomsauce.com (“the Service”). By creating an account you agree to these Terms.

2. What the Service does

BoomSauce is a 1:1 email platform. It provides: domain registration with full DNS and authentication setup (SPF, DKIM, DMARC); mailbox hosting; a peer-to-peer warmup network operated as CheddarInbox; SMTP send capacity; a reply-tracking inbox; and a wallet-based billing system.

The product is intentionally reply-first: first emails to any recipient cannot contain hyperlinks, images, or tracking pixels. This is enforced by the platform and is not configurable. It is a product constraint, not a bug.

3. Accounts

Sign-in is via Google OAuth (email + basic profile only). You are responsible for the security of the Google account you use to authenticate. You must provide accurate information. For volume tiers (50+ domains or 1M+ sends per month) we require identity verification before we provision infrastructure. Accounts that refuse verification at those thresholds will not be activated.

4. Acceptable use

You agree not to use the Service to:

  • Send messages that violate CAN-SPAM, CASL, GDPR, the UK GDPR, or any applicable email law
  • Send to recipients with whom you do not have a legitimate business basis for contact
  • Send without a functioning unsubscribe mechanism and accurate sender identity
  • Distribute malware, phishing content, fraud, or illegal material of any kind
  • Attempt to circumvent the reply-first gate (embedding links/images/trackers in first emails) through any means
  • Abuse the CheddarInbox warmup network — including spoofing engagement or reselling warmup-received mail
  • Circumvent rate limits, wallet checks, KYC requirements, or other security controls
  • Resell, sublicense, or white-label the Service without a written reseller agreement

We monitor outbound content and inbound complaint / bounce rates. Accounts exceeding industry-standard thresholds (5% bounce or 0.1% complaint) may be auto-paused pending review.

5. Pricing, wallet, and billing

The Service operates on a pay-as-you-go wallet model with no subscription tiers and no monthly minimum. Current published rates are:

  • Domain + setup + 1-page website: $25 per domain per year, charged at registration
  • Mailbox hosting: $0.033 per mailbox per day (~$1/month), metered daily for every provisioned mailbox
  • Warmup: $0.25 per 50-email block on the CheddarInbox network, opt-in per mailbox
  • SMTP sends: $1.50 per 1,000 emails, metered per send

You load credits into your wallet via Stripe. Charges are drawn from the wallet balance as consumption occurs. When the balance reaches zero, warmup is paused, the daily mailbox hosting fee accrues but does not force suspension, and new sends are blocked until the wallet is re-funded. Stripe processing fees (2.9% + $0.30) are retained by Stripe from each topup; we credit you the gross amount.

Rates may be adjusted with 30 days’ notice through the platform. Changes do not apply to funds already loaded in your wallet for services already rendered.

Volume pricing below the published SMTP rate is available for partners sending 1M+ emails per month; contact sales for a negotiated rate.

6. Refunds

Unused wallet balance is refundable on request, minus a 10% processing fee (which covers administrative overhead and the Stripe fee we do not recover on the refund path). Consumed services (domain registrations, mailbox hosting days already accrued, warmup blocks already delivered, SMTP sends already dispatched) are non-refundable.

Refund requests are submitted through the in-app support page; refunds typically appear on the original payment method within 5 to 10 business days after approval.

7. Dormant accounts and abandoned credits

Accounts with a positive wallet balance but no activity for 24 consecutive months receive a dormancy notice. At 36 months we send a final notice; at 60 months unclaimed balances may be remitted to the appropriate state unclaimed-property authority in accordance with applicable abandoned-property law. You may reactivate or refund a dormant balance at any time before remittance.

8. Your data and content

You retain ownership of all contacts, email content, lists, templates, and playbook configuration you upload or create. We claim no intellectual-property rights over your content. You grant Nimbus a limited license to process your content solely to operate the Service, deliver your email, and improve reliability.

You are responsible for the lawful basis for every contact you upload. By uploading contacts you represent that you have the right to email them.

9. Third-party infrastructure

The Service depends on third parties including Railway (hosting + database), Stripe (payments), Namecheap (domain registration), SendGrid (SMTP fallback), CheddarInbox (primary SMTP + warmup network, also operated by Nimbus), and Anthropic (AI content classification). See the Privacy Policy for details on how data flows through these processors.

10. Suspension and termination

We may suspend or terminate an account for violation of these Terms, abusive sending practices, failure to pay outstanding charges, or when required by law. You may close your account at any time. On closure we will refund any remaining wallet balance under the terms in Section 6 and delete your data within 30 days unless retention is required by law (tax records, audit trails on the financial ledger, etc.).

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NIMBUS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE SPECIFIC DELIVERABILITY OUTCOMES, REPLY RATES, INBOX PLACEMENT, OR UPTIME. Deliverability depends on factors outside our control including the content you send and the recipient mail provider’s policies.

13. Indemnification

You agree to indemnify and hold harmless Nimbus.io, LLC, its members, officers, and employees from any claims, damages, or expenses arising from your use of the Service, your content, your violation of these Terms, or your violation of any applicable law including email, privacy, and consumer-protection law.

14. Changes to these Terms

We may modify these Terms from time to time. Material changes will be communicated through the platform with at least 30 days’ notice. Continued use of the Service after the effective date of a change constitutes acceptance.

15. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Florida, and each party consents to personal jurisdiction there.
